"The EB-5 program is a win-win situation. It is a great way to create jobs and stimulate the U.S. economy while giving foreign investors a path to permanent residency." Bernstein |
LC: What's the scope of immigration concerns covered at Bernstein
Osberg-Braun & de Moraes Immigration Attorneys?
RB: We focus exclusively on immigration law, including corporate
non-immigrant and immigrant visas, labor certifications, waivers, litigations,
appeals, motions to re-open and consular processing. Also, for many years, we
have been bringing foreign investors to the U.S. through a number of different
non-immigrant and immigrant visa categories.
LC: Foreign investment is certainly a need in this economy. Are there
ways you can expedite visas for investors who want to bring capital into the
U.S.?
RB: Yes, there's a federal program called the EB-5 program that
successfully matches foreign investors with disadvantaged communities
throughout the country. It's open to qualified applicants who invest $1 million
in a new commercial enterprise that employs at least ten full-time workers. An
alternative to direct investment is the Regional Center Pilot Program, which
requires a $500,000 investment in a limited partnership and permits the
investor to indirectly employ ten workers as long as a he or she can reasonably
demonstrate that the regional center has indirectly created or induced ten or
more jobs per investor.
LC: What's the expected impact of the EB-5 program on the economy?
RB: It's estimated that, when fully realized, the program will contribute
$1.5 to $3 billion in foreign capital to the U.S economy each year, and will
also provide and/or preserve more than 30,000 jobs for U.S. workers annually.
LC: Where do the majority of your clients come from?
RB: The majority of our clients are from Europe and Latin America, but we
have a diverse client base from around the world. Our staff is experienced and
multi-cultural, so we're able provide efficient and effective services, in a
broad range of languages, including Spanish, Portuguese, French, German, Hebrew
and Danish. In Aventura there are a lot of Colombians, Venezuelans, Argentines
and Europeans looking to obtain visas by investing capital, so we assist them
in navigating that process.
LC: What experience do you bring to the table?
RB: Prior to going into private proactive I worked for the U.S.
Department of Justice as an Asylum Officer, then as legal counsel to the
Immigration and Naturalization Service. Our attorneys have more than 75 years
of combined experience. We come from many different professional backgrounds
that, combined, give us a practical understanding of the inner workings of
government agencies. That helps us to consistently deliver winning strategies
and stellar results.
