Simplified EB5 Process Timeline

Although the EB-5 Investor Visa process can seem quite complex, this timeline provides a linear, simplified depiction of the entire immigration process. Here the EB-5 process is described chronologically, from the initial point at which the investment funds are transferred, to the filing of the Form I-526 with US Citizenship and Immigration Services, to the filing of Form I-829, which serves as proof of the investment and job creation, and to the final approval of the EB-5 Visa and the eventual return of the investment principal.

EB5 Investor admitted to US; 2-yr conditional period starts. EB5 Investor files I-829 with proff of full Investment, job creation, or preservation USCIS approves EB- Investor's I-829; Conditions lifted USCIS approves EB-5 Investor's I-526; if in US EB-5 Investor files Adjustment of Status Adjustment of Status approved; Applicant is a Conditional Resident; 2yr conditional period starts EB-5 Investor may continue Investment re-negotiate terms of investment, accept an offer of returns of investment principal, etc.
